In a report conducted by the Department of Transportation's National Highway Traffic Safety Administration, 18 percent of hit and run fatalities involved pedestrians. Surviving relatives of victims who died in a hit and run car accident can file a wrongful death claim; however, the claim must be filed within the statute of limitations within that jurisdiction, and must be filed with appropriate paperwork. Victims who sustain injuries in hit and run accidents can file a personal injury lawsuit against the driver of the vehicle.
