January 18, 2013

A settlement has been reached in the Connecticut Wrongful Death lawsuit that was filed against East Hartford, Connecticut, and a local high school in connection to the drowning of a 15-year-old student. According to a story released by The Hartford Courant, the teen’s family, who filed the lawsuit, will receive $1.5 million in damages.

The incident occurred on January 11, 2012 at an indoor pool located at East Hartford High School when the teen, who was supposed to be under teacher supervision, fell or got into the pool. The boy did not know how to swim and drowned.

The city considered charging a teacher with criminally negligent homicide and risk of injury to a minor; however, prosecutors declined to accept the case.

The lawsuit alleged that the teen’s death was the direct result of negligence by the school, its staff, and the town. A decision was reached after the filing that the city of East Hartford’s insurer would be responsible for paying $1 million to settle the claims, while the school district would cover $500,000 of the costs. The boy’s family called the settlement “a fair resolution”.

The Connecticut Personal Injury Lawyers with Carter Mario Injury Lawyers would like to send their thoughts to the family of the victim and hope the settlement can bring them some sense of closure to their loss.
