with the decision and expresses their wish to appeal.
Statement of the Case: The VA sends the applicant a document explaining the evidence, laws, and
regulations used to determine the applicant’s claim.
Substantive Appeal: The applicant completes an appeal form (VA Form 9) and submits it to whichever
VA office has the applicant’s records on file.
BVA Evaluation: The Board of Veterans Appeals (BVA) evaluates the applicant’s appeal,
decides on their claim, and issues a determination in the mail.
BVA Hearing: If an applicant disagrees with a determination, they can go before a board
member. The BVA may then remand the claim to a local office.
Court of Appeals: If an applicant disagrees with a BVA hearing decision, they may file an
appeal with the U.S. Court of Appeals for Veterans Claims.
