East Hartford Police Still Searching For Driver In Hit-And-Run Case

January 30, 2012

Police are still searching for clues to the identity of the driver involved in a East Hartford, Connecticut, hit-and-run that happened nearly two weeks ago. Reports by WTNH 8 News say that the 31-year-old female victim was hit at approximately 5:00 PM, at the intersection of Silver Lane and Simmons Road on January 15.

The East Hartford Police Department says that a newer-model Dodge Challenger struck the woman as she attempted to cross the street. Rather than stopping to help the woman, the driver turned off the car’s headlights and fled, leaving the woman in the street to die. Luckily witnesses at the scene were able to help the woman and call paramedics. She was taken to Hartford Hospital with extensive injuries to her leg, where she has remained for the past two weeks.

Officers believe the dark-colored Challenger involved would have suffered damage to its headlight, bumper, and side view mirror. Evidence also suggests that the driver involved in this accident very well may have been distracted or under the influence at the time of the crash.

In an effort to prevent accidents like this from occurring because of distracted or drunk driving, the Connecticut car accident lawyers with Carter Mario Injury Lawyers are once again sponsoring their Arrive Alive Scholarship. The program awards a $1,000 scholarship to the area young person with the best presentation highlighting the dangers of drunk and distracted driving.

New Research Shows Many Hospital Accidents Go Unreported

January 23, 2012

New evidence from the Department of Health and Human Services shows that many hospital staff members fail to report incidences of wrongdoing. In a new report released from the office of the Inspector General, it is estimated that as many as 86 percent of these incidences go unreported.

The report shows evidence to support that many of these happenings go unreported “because of staff misconceptions about what constitutes patient harm.”

The numbers were calculated during a study that examined records from nearly 1,000,000 Medicare patients who had been discharged from hospitals across the country. From that group, 785 cases were randomly selected for further evaluation. Researchers found 302 cases of patients suffering adverse events during their hospital stay. Of those cases, only 43 were reported.

Interviews with hospital staff and administrators responsible for these cases later determined that most went unreported because the staffer:

  • Did not perceive the event as reportable
  • Failed to properly file a report

To alleviate the problem, researchers suggested that a list of reportable events be created for distribution to hospital administrators. They also recommended that those responsible for hospital reporting systems should examine and improve the system where possible.

The Connecticut medical malpractice attorneys with Cater Mario Injury Lawyers encourage anyone who has suffered at the hands of a negligent doctor or medical staff to report the event to hospital administrators as soon as possible. Contacting an attorney may also be in your best interests.

East Hartford Teen Drowns In High School Swimming Pool

January 16, 2012

The drowning of a 15-year-old high school freshman has rocked the town of East Hartford, Connecticut. According to reports from WTNH 8 News, the accident happened during a gym class at East Hartford High School last Wednesday around noon.

Although the events surrounding the incident have been kept fairly quiet by school officials and staff, it has been made clear that the student, along with around 30 others, were under the supervision of a gym teacher when the boy was found submerged in the water. That teacher attempted to give CPR until paramedics arrived and took the teen to Hartford Hospital where he was pronounced dead.

The state medical examiner’s office confirmed this morning that the teen died as a result of asphyxia by submersion. Detectives and school officials are still investigating the incident.

CBS News reported that while an estimated 10 people per day drown in pools, many of those accidents occur when lifeguards and others supervising are just feet away.

Being able to prove that a victim’s death was the result of improper supervision from a responsible party can be vital in this type of a wrongful death lawsuit. Tort Reform Keeping Legitimate Cases Out Of The Courtroom?

January 9, 2012

Someone who has been truly wronged is entitled to seek justice for their personal injuries in court. This is a right that most Americans hold as close to their hearts as any other constitutional right. But, according to an article by WTNH 8 News, a change in the filing procedures for lawsuits in the state of Connecticut is keeping some victims from receiving the legal aid they need.

In 2005, an amendment to the state’s medical malpractice law was made that requires plaintiffs to supply a letter from a medical expert backing their claims before a suit can be filed. These letters can cost a victim thousands of dollars to receive from the doctor. Not to mention the victim has to pay the expert doctor again to testify on their behalf at the trial.

Even if a patient is able to afford a doctor to testify on their behalf, the wording of the law is having numerous legitimate cases thrown out before the case is ever presented to a jury or judge. The law states that a plaintiff’s medical expert must have similar credentials to that of the accused. A misinterpretation of that law, where cases were dismissed because experts and doctors did not have exact matching credentials, has seen hundreds of cases dismissed before they are ever heard.

These types of complications in the law and judicial system point out just why it is vital to have a lawyer on your side when filing a Connecticut personal injury lawsuit. If you have been injured, get in touch with the Connecticut personal injury attorneys with Carter Mario Injury Lawyers today!

FDA Issues Second Warning About Dangers Associated With Massager

January 2, 2012

The Food and Drug Administration (FDA) is warning citizens of the dangers an electric massage device may pose to consumers. According to a press announcement from the agency, consumers should stop use immediately of the ShoulderFlex Massager, imported by King International and sold by various companies, due to serious potential health risks.

The FDA Says that hair, clothing, and jewelry can become entangled in the device, which can lead to strangulation and possibly death.

The product was recalled August 31, 2011, after reports of one fatal and another near fatal accident associated with the product; however, it was discovered in a recent compliance audit that the company had gone out of business before completing the recall process. Now, the FDA is concerned that the product may still be on shelves, and that retailers and consumers alike may not be aware of the dangers the product poses.

To properly dispose of the product they suggest:

  • Removing the massage fingers from the device
  • Removing the power supply (cord) from the device
  • Disposing of each part separately

The agency added that all injuries or deaths associated with the product should be reported to the agency’s MedWatch Safety Information and Adverse Event reporting Program.

Connecticut House Fire That Killed Five Caused By Discarded Embers

December 26, 2011

The efforts to keep warm by some Connecticut families in recent weeks have cost them more than they bargained for. The New York Times released a news yesterday about a house fire that destroyed a Victorian home owned by a prominent New York advertising firm executive. The fire was caused by discarded embers that were removed from the fireplace on Christmas night.

The female executive had gathered with her parents and children at her home in Stamford, Connecticut, along with a worker staying at the house while renovating it. At around 3:00 AM Sunday, the 47-year-old woman removed the embers from the fireplace and put them in a bag in the mudroom of the home. Hours later the woman was found in the driveway screaming that her children and parents were trapped in the burning home.

By the time firefighters arrived, the house was engulfed in flames and too hot to enter. The woman’s three young daughters and parents perished in the flames. The woman and worker who survived were hospitalized for injuries they received escaping the fire.

The Connecticut fire and burn injury lawyers with Carter Mario encourage you to immerse all fire ashes in water before discarding if you are utilizing your fireplace this season. If you or a loved one has been injured in a fire and burn accident, contact an experienced attorney today with questions regarding your case.

Three-Car Accident Injures All Drivers Involved

December 19, 2011

An accident involving three vehicles in Burlington, Connecticut, this morning sent all three drivers to area hospitals. WTNH 8 News reported that the accident happened at 8:50 AM along Route 4, near Lewis S. Mills High School.

Troopers with the Connecticut State Police said the accident occurred when a man driving westbound in a gray SUV veered into the opposite lane of the two-lane road and hit a woman driving a black Ford Focus head-on. The person driving a green Honda behind the Focus swerved to avoid the collision and rolled over an embankment.

The drivers involved in the head-on collision were both airlifted by Lifestar Helicopter to Hartford Hospital to be treated for severe and life-threatening injuries. The driver of the green Honda was able to exit the vehicle herself, but was taken by ambulance to Hartford Hospital to be examined.

State Troopers believe speed may have played a part in the crash, but stated that they will have to wait until the conclusion of their investigation to confirm the suspicion.

According to the National Highway Traffic Safety Administration (NHTSA), speed is one of the top three factors involved in fatal motor accidents, just behind drunk and distracted driving.

The Connecticut Auto Accident Attorneys with Carter Mario Injury Lawyers would like to remind motorists that one of the best ways to prevent accidents on the highway is to slow down. It allows more reaction time for obstacles that may be in the road and lessens the impact if the driver is involved in a crash.

Rental Company’s Negligence Blamed For Death Of Connecticut State Trooper

December 12, 2012

Debate is swirling around a Connecticut courtroom where the widow of a state trooper is suing the company that rented the car to the man who hit and killed her husband. According to NBC-Connecticut, the woman is seeking damages from Enterprise Rent-A-Car, claiming they did not ask for the man’s driving or criminal background before renting him the car that ultimately killed her husband.

It was September 2, 2010, when the Connecticut state trooper pulled over a vehicle on a routine traffic stop along the northbound lanes of Interstate 91 near Enfield. He was in his patrol car writing a ticket when a driver approaching from behind at high speeds swerved off of the road and struck the rear-end of the trooper’s patrol car. Because he was not buckled in at the time of the impact, the trooper sustained severe injuries in the accident, which he later died from.

The lawsuit is claiming the Enterprise Rent-A-Car did not ask the man to disclose the details of his past convictions related to motor vehicles, nor whether his license had ever been suspended or revoked due to driving under the influence. Prosecutors say asking these simple questions would have required the man to disclose a lengthy and checkered criminal past that included convictions for DUI and narcotics, as well as several license suspensions.

The Connecticut Wrongful Death Attorneys with Carter Mario Injury Lawyers may be able to help you if you think that someone else’s negligence may have caused an accident that killed your loved one.

Re-Engineering Streets Could Make For Safer Driving

December 5, 2011

Traffic around Hamden, Connecticut, should see some drastic improvements coming after a study aimed at finding improvements for east-west traffic in the area was completed. According to the New Haven Register, recommendations from the research were presented to a group of around 60 residents last Wednesday night at the Miller Senior Center.

The study attempted to gather information from the public regarding potential improvements to Armory, Augur, Treadwell and Waite streets, Putnam Avenue and Connolly Parkway by conducting online surveys and gathering of residents at several town meetings. Their recommendations were then taken by city planning organization, Fitzgerald & Halliday, to see what would actually be viable. To their surprise, more than they originally thought could be used.

The group’s recommendations were broken into three specific categories:

  • Pedestrian and bicycle improvements
  • Intersection safety improvements
  • Traffic calming

One of the simplest and most effective changes suggested was painting lines on the streets at crosswalks to make the crossing more visible to both drivers and pedestrians.

Some suggestions were not so simple, yet could still be very effective. Several plans were discussed to calm traffic on Connolly Parkway and the Waite-Mather-King-Belmont area. Building a rotary was discussed, but the area was too small.

The Connecticut Auto Accident Attorneys with Carter Mario Injury Lawyers believe the engineering of streets can help alleviate traffic dangers. If you have been involved in an auto accident no fault of your own, contact an experienced attorney today to help answer any questions you have regarding your case.
